An East Petersburg man admitted Monday in Lancaster County Court to sending a lewd photo to a 15-year-old girl.
Luis A. D. Smith, now 19, will serve 6 to 23 months in prison, followed by 5 years of probation, in accordance with a plea agreement arranged by Assistant District Attorney Janie Swinehart.
Lancaster County Judge Merrill Spahn accepted the terms and ordered sentence, which also includes a 25-year registration under Megan’s Law.
Smith pleaded guilty to felony counts of disseminating explicit sexual material to a minor and unlawful contact with a minor, and a misdemeanor count of corruption of minors, in exchange for the sentence.
Smith sent the lewd photo to the girl, via Facebook Messenger, in November 2014.
As part of sentence, Smith must also abide by regulations for convicted sex offenders, including limitations on internet access and smartphone usage, and a ban from unsupervised visits to parks and schools.
Smith's prior criminal record factored into sentencing guidelines.
A hearing will be held in a couple months to determine if Smith be classified as a “sexually violent predator.”
