Found guilty of: Rape by Forcible Compulsion (F1), IDSI by Forcible Compulsion (F1); Aggravated Indecent Assault by Forcible Compulsion (F2); Terroristic Threats (Domestic Violence) (M1); 2 counts (Unlawful Restraint (M1); 2 counts Simple Assault (Domestic Violence) (M2); Sexual Assault (F2)

Judge: David L. Ashworth

Defense: William Hobson, Philadelphia, Pa

Brief summary of facts: The Defendant and the victim had dated for over 1 ½ years and had recently broken up. Between March 2nd and 3rd, 2014, the defendant did threaten his ex-girlfriend with two knives for several hours telling her that there would be blood today, it was the last day she would see anyone, and she had a choice of whether he cut her in the face or stabbed her. He pushed her, shoved her, slapped her, broke off her nail, and poked her with the knife repeatedly during this night-long assault and sexual attack. He then put one of the knives standing up into a box on the dresser in the bedroom so she could see it and repeatedly told her not to do anything stupid. He then forced her to pose naked for pictures that he took on his cell phone, forced her to perform oral sex on him and forced sexual intercourse on her three times throughout the night. He would not leave and would not allow her to leave. As soon as she was free from him the following morning, she made a prompt complaint and there was a thorough investigation conducted by Manheim Twp. PD that resulted in charges.

Jury was out approximately 3 hours and he was found guilty of all charges. They also found beyond a reasonable doubt that Gavilan-Cruz both possessed and used a deadly weapon to commit each of the crimes.
